Este material didáctico es la respuesta a uno más de los retos provocados por la adaptación de los estudios de la UIB al espacio europeo de educación superior: afrontar la enseñanza de una nueva asignatura, de formación básica y carácter interdisciplinario «aun cuando jurídico», que comparten los estudiantes de Derecho, Economía, Administración y Dirección de Empresas, Geografía y Turismo. Bajo la dirección y coordinación del decano de la Facultad de Derecho y los directores de los departamentos de Derecho Público y de Derecho Privado, se ha preparado este texto, que, más que un manual, sistemático y homogéneo, es un paseo por el mundo del derecho, para el cual se pidió a los autores que, con gran libertad de estilo y criterio, explicaran los contenidos de los descriptores con los que esta asignatura se incluye en los planes de estudios de los grados mencionados.
Los Ensayos Jurídicos del profesor Luis Díez-Picazo, contienen una recopilación sistematizada de todos los artículos doctrinales y demás trabajos publicados por el autor a lo largo de los años hasta el día de hoy. Como corresponde a su especialidad, la mayoría son estudios de Derecho civil, especialmente de Derecho civil patrimonial, pero dada su condición de jurista total, sin zonas exentas, como pone de relieve el profesor Eduardo García de Enterría en la presentación de la obra, los más de 300 trabajos recopilados se extienden prácticamente a todos los campos del Derecho (filosofía, constitucional, mercantil, etc.). El Tomo I agrupa, en primer lugar, los estudios que se ocupan de la Teoría General del Derecho, de las fuentes y del derecho subjetivo, incluida la prescripción. También recoge los estudios sobre Derecho de la persona y sobre Derecho de la familia. El Tomo II recoge los ensayos dedicados a las materias centrales del Derecho civil patrimonial, a las que como es notorio el autor ha dedicado sus mejores esfuerzos y en las que es un reputado especialista: Derecho de obligaciones y contratos, Derecho de Daños y Derecho del enriquecimiento injustificado. El Tomo III contiene los estudios relativos al Derecho de cosas y al Registro de la Propiedad, al Derecho de Sucesiones y al Derecho Mercantil. Se completa con otros ensayos sobre temas varios. Destacan el que versa sobre Derecho y Literatura, y las semblanzas realizadas por el autor de algunos de nuestros más conocidos juristas, como su maestro Federico de Castro, don Jerónimo González o don Juan Vallet de Goytisolo.
